No purchase necessary to enter or win. Product purchase will not enhance chances of winning a prize.
Open only to legal residents of the United States and the District of Columbia. You must be over the age of 18 at the time of registration to enter.  Only one entry per person is permitted. Multiple entries will be disqualified, with the exception of when the additional online survey is completed.

1. Online Entry
To enter online, complete and submit the online entry form located at ____________________URL___________ Entrants consent to the internal use of the survey data by Sponsor. Online entries will be deemed to have been submitted by the authorized account holder of the e-mail address submitted at the time of entry. "Authorized account holder" is defined as the natural person who is assigned to an e-mail address by an Internet access provider, online service provider or other organization responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. It is the sole responsibility of the entrant to notify the Sponsor in writing if the entrant changes his or her email address.
 
2. Sweepstakes and Winner Notification
The winner will be selected in a random drawing from all eligible entries. All drawings will be conducted by Sponsors whose decisions are final on all matters relating to this sweepstakes. Odds of winning depend on the number of entries received. The potential winner will be notified via phone, e-mail, and/or mail. If a potential winner cannot be contacted within 10 days, using reasonable efforts, or if the potential winner has not or does not comply with these rules, an alternative winner may be randomly chosen. Sponsor is not responsible for and shall not be liable for late, lost, misdirected, or unsuccessful efforts to notify winner. (You may obtain the winner's name by sending a self-addressed, stamped envelope to the above address). In the event a prize is unclaimed, another winner will be randomly chosen.

3. Deadlines
The Sweepstakes begins on _______________  and ends on____________. All entries must be received on or before ________________ 11:59 P.M. P.S.T. to be included in the drawing. The drawing will be held on or about ______________. Proof of sending shall not be deemed proof of receipt or delivery. Entries are not deemed to be made until received online by Sponsor (as hereinafter defined).

4.  Sponsor, Prize and Odds of Winning Information
The Sweepstakes is sponsored by James Allyn Inc. ("Sponsor"). The prize consists of an Apple iPhone 8GB. One winner will be chosen for this Sweepstakes.  Winner will be determined by a random drawing from all eligible entries received from all methods of entry on or about _______________. Odds of winning depend on the number of eligible entries received. By participating in this sweepstakes, entrants agree to be bound by these rules and by the decisions of the Sponsor which is final in all matters relating to this Sweepstakes. The prize is not transferable. This prize cannot be used in conjunction with any other Sweepstakes or offer. Prize is non-transferable and non-redeemable for cash. No substitution of prize is permitted and prize is subject to availability. Sponsors reserve the right in their sole discretion to substitute a prize with a prize of comparable value. Prize winner is solely responsible for any and all applicable federal, state and local taxes, as well as, any other fees/incidentals not included in the prize(s) that become due with respect to prize. Prize winners are solely responsible for all insurance with respect to the prize. Sponsors are not responsible for lost or stolen prizes once they are awarded.

5.  Winners List and Official Rules
Winner may be posted at www.JamesAllyn.com after winner is notified and eligibility is confirmed. To obtain a printed copy of these Official Rules or a list of winners via mail, send a self-addressed, stamped envelope to 6575 Trinity Court, Suite C, Dublin, CA 94568. Please specify whether you are requesting the Official Rules or a list of winners.

6. General Conditions and Eligibility
Entrants must properly and completely fill out the online entry form and abide by these Rules. In the event of a dispute, the decision of Sponsor shall be final and binding, and no correspondence will be entered into. Sponsor reserves the right to verify eligibility qualifications of all winners. Employees and immediate families including household members of Sponsor are not eligible. All entries and the information and the copyrights contained in such entries, will become the Sponsor's property and will not be acknowledged or returned.. The winner may be required to sign and return (notarized) an affidavit of eligibility, liability release, and a publicity release before receiving a prize. Failure to return these completed documents in the time required will result in disqualification. Acceptance of a prize will constitute permission for Sponsor to use the names, cities, states, likenesses, and voices of the winners for advertising and promotional purposes, without any further compensation, unless prohibited by law. By entering, entrants (i) acknowledge compliance with and agree to these Rules including all eligibility requirements, (ii) agree to be bound by the decisions of the Sponsor, which are final and binding in all respects, and (iii) agree that no claim relating to such damages, losses or injuries shall be asserted against Sponsor, Cosponsors or their agents, affiliates, subsidiaries, divisions, and advertising and promotion agencies. If, for any reason, the Sweepstakes is not capable of running as originally planned, the Sponsor, at its sole discretion, reserves the right to cancel the Sweepstakes without liability. This Sweepstakes is subject to all Federal, state, local and provincial laws and regulations. Void where prohibited or restricted by law.

7. Internet
a) Entries made via the Internet will be deemed made by the authorized account holder of the e-mail address submitted at the time of entry. If for any reason the online portion of the program is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the reasonable control of Sponsor which corrupt or affect the administration, security, fairness, integrity, or proper conduct of this Sweepstakes, Sponsor reserves the right in its reasonable discretion, to cancel, terminate, modify or suspend the Sweepstakes.
b) Sponsor reserves the right in its reasonable discretion to disqualify any individual it reasonably believes to be tampering with the entry process or the operation of the Sweepstakes or web site; to be acting in violation of the Rules; or to be acting in an unsportsmanlike or disruptive manner, or with intent to disturb, abuse, threaten or harass any other person. ANY ATTEMPT BY A CONTESTANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE PROMOTION IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH CONTESTANT TO THE FULLEST EXTENT PERMITTED BY LAW.
c) Sponsor excludes all liability for any error, omission, interruption, deletion, defect, delay in operation, or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries. Sponsor excludes all liability for any problems or technical malfunction of any telephone network or lines, computer on-line systems, servers, or providers, computer equipment, software, failure of any e-mail or entry to be received by Sponsor on account of technical problems or traffic congestion on the Internet or any website, or any combination thereof, including any injury or damage to participant's or any other person's computer related to or resulting from participation or downloading any materials in this Sweepstakes.
d) Any entry which is damaged, corrupted, defaced, ineligible or incomplete, or which otherwise does not comply with these rules, may be deemed to be invalid in the reasonable discretion of Sponsor.

8. Limit of Liability and Disclaimers

 

a) ALL ENTRANTS AGREE THAT SPONSOR, AND ALL SUPPLIERS OF PRIZES INVOLVED IN THE DEVELOPMENT, PRODUCTION, IMPLEMENTATION, AND DISTRIBUTION OF THIS PROMOTION, INCLUDING THEIR RESPECTIVE PARENT COMPANIES, AFFILIATES, SUBSIDIARIES, AND AGENCIES AND/OR ANY OTHER PERSON OR ENTITY ASSOCIATED WITH THE PROMOTION SHALL NOT BE LIABLE FOR CLAIMS, LOSSES OR INJURIES OF ANY KIND RESULTING IN ANY WAY FROM ENTRANT'S PARTICIPATION IN THE PROMOTION; INCLUDING BUT NOT LIMITED TO, THE DRAWING, THE USE OF THE PRIZES, ANY DELAYED, LOST, MISDIRECTED, OR DAMAGED ENTRIES, OR ANY COMPUTER, HUMAN, ONLINE SERVICE, COMMUNICATIONS OR OTHER TECHNICAL MALFUNCTIONS OR ERRORS THAT MAY OCCUR.

 

b) SPONSOR AND ALL SUPPLIERS OF PRIZES INVOLVED IN THE DEVELOPMENT, PRODUCTION, IMPLEMENTATION, AND DISTRIBUTION OF THIS PROMOTION, INCLUDING THEIR RESPECTIVE PARENT COMPANIES, AFFILIATES, SUBSIDIARIES, AND AGENCIES AND/OR ANY OTHER PERSON OR ENTITY ASSOCIATED WITH THE PROMOTION MAKE NO WARRANTY OF ANY NATURE IN RESPECT OF ANY PRIZES, WHETHER IN RESPECT OF FITNESS FOR PURPOSE, SATISFACTORY QUALITY, DESCRIPTION OR NATURE OF PRIZES OR OTHERWISE. ALL CONTESTANTS ACKNOWLEDGE THAT, EXCEPT AS SET FORTH HEREIN, THE SPONSOR HAS NOT MADE AND DISCLAIMS ALL LIABILITY FOR ANY WARRANTY, REPRESENTATION, OR GUARANTEE, EXPRESS OR IMPLIED, IN FACT OR IN LAW, RELATED TO ANY PRIZE. ALL CONTESTANTS, BY ENTERING THE PROMOTION, AGREE TO BE BOUND BY THE ABOVE RULES.
